TERMS AND CONDITIONS - LAURA THE EXPLORER

Laura the Explorer request that you read over the following Terms and Conditions before booking one of our Tours.

 The terms “we”, “us” and “our” refer to Laura the Explorer and “you,” your”, “their”, “they” and “participant” refer to the customer.

 By booking a tour with Laura the Explorer Adventure Tours, you are agreeing to the following terms and conditions:

1.     PAYMENT AND DOCUMENTATION

1.1 The Booking Form must be completed and accurate including all medical, dietary requirements or other information that is relevant for the Tour.

1.2 Any medical information provided will be held privately with your tour guide as per our Privacy Policy.

1.3 You must not embark on a tour if you have any form of medical condition, mental health condition, injury, illness, contagious disease, or any other condition which would impact on your ability to participate in group activities safely, or which would put at risk the safety and wellbeing of other passengers.

1.4 A 50% deposit is to be paid on booking. Full payment is required 30 days prior to departure.

1.5 Confirmation of your booking will be sent once final payment has been made.

2.     ITINERARIES AND DESCRIPTIONS

2.1 We reserve the right to change the itinerary and/or substitute any vehicle types, activities, accommodations, or transportation for any reason, including but not limited to safety, weather, or other unforeseen circumstances.

2.2 We cannot guarantee pick up and drop off times, however all efforts are taken to provide the best experience possible for each passenger.

2.3 Participants must provide their own transportation to and from the tour starting and ending points.

2.4 Participants must provide their own sleeping bag and personal effects unless otherwise specified by us for your booked Tour.

2.5 Prices quoted are per person, for 2 people sharing accommodation.

2.6 Booking requests are made subject to availability.

2.7 Tour prices and these Terms and Conditions are subject to change at any time at our discretion.

3.     TRAVEL INSURANCE

3.1 We highly recommend that you have personal travel and medical insurance which will provide you with the best cover for your own personal circumstances.

3.2 Participants are responsible for their own medical insurance and medical expenses.

4.     CANCELLATIONS AND REFUNDS

4.1  If you cancel;

a.     30 days or more prior to the day of departure the full amount less 25% will be refunded or you can transfer to another Tour (see 4.3)

b.     14-29 days prior to the day of departure the full amount less 50% be refunded or you can transfer to another Tour (see 4.3)

c.     Within 14 days or less before day of departure no refund will be given.

4.2 All cancellations or request to transfer must be made in writing to info@lauratheexplorer.com.au

4.3  If up to 14 days before the original Tour commences you need to change your Tour, you can transfer to another one of our Tours, provided you have express written approval by us and the following conditions apply;

a.     The transfer may be applied to any one of our Tours

b.     The credit is valid for one (1) year only.

c.     There is no transfer fee, but you may need to pay a difference in trip costs.

4.4 If you fail to join a tour or leave before its completion, you will not receive a refund for unused services.

4.5 If we are forced to cancel, we will offer you the option of;

a.     a refund of the cost, or

b.     booking a future tour.

4.6 We reserve the right to cancel or reschedule the tour due to unforeseen circumstances, including but not limited too severe weather and natural disasters. In these circumstances you will be eligible for a refund of the cost minus the booking deposit.

4.7 Our departures will be subject to numbers. If we need to cancel a tour or service, every effort will be made to offer a suitable alternative. If no alternative is available, we will refund the cost.

5.      GENERAL TERMS AND RESPONSIBILITY

5.1 We reserve the right to terminate the participation of any participant who does not comply with these Terms and Conditions or who engages in behaviour that is detrimental to the safety or enjoyment of other participants. Our primary consideration is the safety of all passengers, staff and people we come into contact with during our Tours.

5.2 We are not responsible for any additional expenses incurred by participants as a result of changes to the itinerary or other unforeseen circumstances.

5.3 Participants must be in good physical health and capable of participating in the activities included in the tour, such as hiking and camping.  We will not be held responsible for any injuries or health issues or other medical conditions that may occur during the tour.

5.4 Participants are responsible for their own personal belongings and equipment, and we are not liable for any lost, stolen, or damaged items.

5.5 Participants must follow all safety instructions provided by the tour operator and its staff, and must not engage in any activities that may be dangerous or harmful to themselves or others.

5.6 Participants must respect the local flora and fauna, and adhere to all state/federal laws as well as national and local park regulations.

5.7 Every Tour is supported with contingencies in place to provide the best experience possible in any adverse situation. We proudly stand by our strong record of operating a reliable and well maintained fleet.

5.8 By participating in the tour, participants agree to allow us to use any photographs or videos taken during the tour for marketing and promotional purposes as per our Privacy Policy.

5.9 By participating in a Tour, participants agree to these Terms and Conditions and acknowledge that they have read and understood them.

6.     JURISDICTION

6.1  It is a condition of booking that all parties agree that the transaction occurs in the Australian State of Western Australia and that the applicable laws of Western Australia shall apply.

6.2  All parties unconditionally agree to submit any dispute in connection with the booking agreement to the jurisdiction of the Courts of Western Australia.
